Article 1: Scope and modification of the general terms and conditions of sale

The company A.C.S reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order. A.C.S advises the consumer to save and/or print out these general terms and conditions of sale for safe and durable storage, enabling them to be invoked at any time during the performance of the contract, should the need arise.
Article 2: Purpose
The purpose of these general terms and conditions of sale is to define the rights and obligations of the parties and the conditions applicable to any purchase made through the company's e-commerce site A.C.S,www.https://auto-cles-services.fr/gb/telecommande-plip-coque-de-cle-auto-peugeot-citroen-renault-audi-bmw-vw whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these general conditions of sale.
Article 3: The order
The order can only be registered if the consumer is clearly identified: either by logging into their account using their access codes, or by creating an account at www.https://auto-cles-services.fr/gb/telecommande-plip-coque-de-cle-auto-peugeot-citroen-renault-audi-bmw-vw if it has not yet been registered.
Any order implies acceptance of the prices and description of the products available for sale. The contract is deemed to have been formed when the order confirmation is issued. Once the order has been validated, it is sent to our logistics department for processing. Consumers may obtain information on the status of their order at any time, either by logging on to their account, under Order Tracking, or by contacting Customer Services by e-mail at contact@auto-cles-services.fr
Article 4: Acceptance and proof
Acceptance of the general terms and conditions of sale (tick box) constitutes irrevocable and unreserved acceptance of the order by the consumer.
The computerised registers kept in the company's computer systems are subject to the following conditions A.C.S in reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties.
Article 5: Product information
A.C.S presents on its website the products for sale and the characteristics required in accordance with article L 111-1 of the French Consumer Code, enabling the potential consumer to know the essential characteristics of the products he or she wishes to buy before placing a definitive order. Please note that the photos are non-contractual.
Article 6: Prices
Prices are given in euros, inclusive of all taxes and exclusive of delivery costs. They include French VAT in force on the day of the order.
A.C.S reserves the right to modify its prices at any time and without prior notice, but undertakes to apply the prices in force when the order is registered.
Depending on the value of the order, the consumer will have to pay delivery charges:

Article 7: Payment methods
7.1 credit card
Consumers may pay for their order using one of the following payment cards:
- VISA
- MasterCard
- other credit cards
Payment is made on the bank server of our partner (Banque Populaire du Nord). The consumer's credit card details are encrypted using SSL (Secure Socket Layer) protocol and are never sent unencrypted over the network. Payment is made directly to the bank. A.C.S does not have access to these details under any circumstances, and does not store them on its servers. This is why they are requested again for each new transaction on our site.
7.2 Cheque
Cheques must be issued by a bank domiciled in mainland France or Monaco and made payable to A.C.S If the consumer is able to do so, and in order to facilitate the processing of the order, we advise the consumer to print out the order confirmation e-mail and attach it to the cheque.
IMPORTANT: if you pay by cheque, delivery times will be extended. Processing of the order will begin on receipt of the cheque.
7.3 Bank transfer
If you do not wish to use your bank card, you can pay by bank transfer, directly into our account. You must then pay the full amount within 5 days, otherwise your order will be cancelled. Don't forget to quote your order number when making your payment. Your order will be dispatched immediately upon receipt of your payment.
7.4 PAYPAL
The PayPal system is an electronic payment service that allows consumers to pay for purchases, receive payments, or send and receive money. They can use this service to make one-off or occasional payments, or they can open a PayPal account to make regular payments.

7.5 Administrative mandate
On behalf of a local authority, town hall or other type of administrative organisation, you can make payments by administrative mandate.
1. Create your account in just a few minutes using registration form.
2. Select and add your products to the basket on our site.
3. Confirm your basket and delivery address.
4. Select the "mandat administratif" payment method and confirm your order.
5. Download the administrative mandate form on the following page or by clicking on the link provided by email.

Article 8: Anti-fraud controls
A.C.S checks all orders validated on its site. These controls aim to protect A.C.S abusive practices by fraudsters.
As part of these procedures, A.C.S may be required to ask the consumer for supporting documents necessary for the order to be released. These requests will be made by e-mail and/or by post with acknowledgement of receipt.
A.C.S is the recipient of the data relating to the order. Failure by the consumer to provide data relating to the order will prevent the transaction from being processed and analysed. The occurrence of an unpaid order due to fraudulent use of a bank card will result in the registration of the consumer's details associated with this unpaid order in a payment incident file implemented by A.C.S. An irregular declaration or anomaly may also be dealt with specifically.
In accordance with the French Data Protection Act of 6 January 1978, consumers have the right to access, rectify and object to all their personal data at any time, by writing to us and providing proof of their identity.
Article 9: Delivery times
The delivery time for each product is specified on the site by clicking on the "See this product" button.
Orders are dispatched Monday to Friday within 24 to 48 hours
There are three possible scenarios:

The product is advertised as being "in platform stock": the delivery time is 2 to 3 days

The product is advertised as being "in supplier's stock": shipping time is 4 to 15 days

The product is advertised as being "in progress at D+30": the estimated delivery time is one month. Consumers can contact customer service to find out the exact delivery time.
In the first two cases, the maximum delivery date will be specified to the consumer during the order process.
Delivery time for services :
For the electronic repair service, the delivery time is 48H00 or 72H00 excluding postal delivery times
For the programming service on boitier immo, BSI... the delay is 72H00 excluding postal delays
For the coded key copy service, the deadline is 48H00 excluding postal deadlines
Article 10: Delivery terms

Home delivery by post delivery time 2 to 3 working days for metropolitan France, 3 to 7 days for Europe.

Shipments are made by La Poste: recorded delivery, colissimo with or without signature, registered letter with R2 insurance see R3 for services to mainland France and Corsica only and in POSTEXPORT envelopes, international colissimo for the European Union and Switzerland.

Article 11: Delivery problems caused by the carrier
On receipt of the parcel, the consumer must check its condition in the presence of the delivery person. If the consumer finds that the parcel is damaged or has been opened, they are advised to refuse the parcel. A.C.S will then be responsible for settling the dispute with the carrier. If he accepts it, he will have to specify the anomaly in the "reserves" of the transport slip. At the same time, the consumer must confirm this anomaly by sending a registered letter with acknowledgement of receipt to the carrier within 72 hours of the delivery date, setting out the aforementioned claims. The consumer must send a copy of this letter by email or by post.
Article 12: Delivery errors
Once the parcel has been received, the consumer must check that the order is in order. Any claim of delivery error and/or non-conformity of the products must be sent to Customer Services by email contact@auto-cles-services.fr on the day of delivery or, at the latest, on the first working day following delivery.
One of the products is missing: the consumer must send a complaint by e-mail to contact@auto-cles-services.fr and contact customer services. After checking with our logistics department, A.C.S will return the missing product to the consumer at its own expense.
Article 13: Unavailability of goods ordered
If the contract is not fulfilled by A.C.S resulting from the unavailability of the goods ordered, A.C.S will inform the consumer and, where appropriate, reimburse him/her without delay and at the latest within thirty days of payment of the sums paid. When he is in a position to do so, A.C.S will offer the consumer the possibility of supplying goods of equivalent quality and price.
Article 14-1: Product warranty
All items marketed by A.C.S on the www.https://auto-cles-services.fr/gb/telecommande-plip-coque-de-cle-auto-peugeot-citroen-renault-audi-bmw-vw are subject to a legal guarantee of conformity (L211-1 of the French Consumer Code) and a guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), enabling it to return defective items.

Article L211-4 of the Consumer Code
The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was his responsibility under the contract or was carried out under his responsibility.
Article L211-5 of the Consumer Code
To conform to the contract, the goods must :
1 º Be fit for the use ordinarily expected of similar goods and, where applicable :
- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model ;
- have the qualities that a purchaser may legitimately expect having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling ;
2 º Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Article L211-12 of the Consumer Code
Any action arising from a lack of conformity must be brought within two years of delivery of the goods.
Article 1641 of the French Civil Code
The seller is liable for any hidden defects in the goods sold which render them unfit for their intended use, or which impair that use to such an extent that the buyer would not have purchased them, or would have paid a lower price for them, had he or she been aware of them.
Article 1648 paragraph 1 of the Civil Code
Any action arising from redhibitory defects (latent defects) must be brought by the purchaser within two years of discovery of the defect.

Article 14-2: Repair guarantee
Our repairs are guaranteed for 6 months (six months).
The contractual commercial guarantee covers the spare part(s) changed during the repair. No warranty will be given by the Seller in the event of modification of the equipment, accident or shock, deliberate deterioration, damage caused by water, fire, damp or lightning. There will be no guarantee in the event of abnormal use.if the appliance is immobilised for repair, any period of immobilisation of the good of at least seven days will be added to the duration of the guarantee that remained to run on the date of the consumer's request for intervention or on the date the good was made available, if this is later. Intervention and repair times depend on the time taken to supply the parts required to repair the appliance.as a result, the Vendor undertakes to intervene (except during holiday periods or in cases of force majeure) within the two-week intervention period, but cannot commit to repair times. Response times for remote controls and transmitters: 48H00 to 72H00.on expiry of the contractual commercial guarantee, and during the period in which the Seller is able to obtain the parts, new or second-hand, required to repair the appliances concerned, or has these parts in stock, the Seller will, if the Buyer so wishes the repair of the appliance in accordance with the conditions and price list displayed in the Vendor's premises on the day of the request for service; these conditions and price list will be communicated to the Buyer remotely on simple request, on the day of a request for after-sales service concerning the appliance specified above. The cost of transport and return insurance shall be borne by the Buyer if the Buyer returns the equipment to the Seller for repair. The Seller will not carry out any work at the Buyer's home.
Article 14-2: Spare parts guarantee
All our spare parts are guaranteed for 1 year
In the event of a product defect during the warranty period, the customer must return the products for warranty coverage.
The cost of sending the product shall be borne by the Customer.
will not be covered by the warranty:
- inserts, key blades cut by a third party other than our cutting service
- neimans with an additional key blade insert cut by a third party other than our cutting department.
Article 15: Right of withdrawal / Terms of exchange or refund
In accordance with the law, the consumer has a cooling-off period of fourteen clear days from delivery of the products and may return them for exchange or reimbursement.
For deliveries by post/coliposte :
The consumer must inform A.C.S by email contact@auto-cles-services.fr for a returns number. To be accepted, the returned product must be in perfect condition and in its original packaging, unopened or not.
Products must be returned with the returns form (provided by Customer Services).
Re-shipment costs shall be borne exclusively by the consumer.
In the case of an exchange, A.C.S undertakes to deliver the new product requested as soon as possible.
In the case of a refund, A.C.S will reimburse the consumer for all sums paid, excluding delivery costs, as soon as possible and no later than thirty days following the date on which the right of withdrawal was exercised.

- Transmitters/remote controls new, used, sold for parts
- Coded keys (with transponder)
- Cut inserts
Article 16: Applicable law and jurisdiction in the event of a dispute
These terms and conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought before any legal action is taken, which will not interrupt the period for bringing an action under the guarantee. Failing this, the principle of territorial jurisdiction will apply to determine the competent court to settle the dispute relating to the contract.
Under articles 42 et seq. of the Code of Civil Procedure:
Unless otherwise provided, the court with territorial jurisdiction shall be that of the place where the defendant resides.
The defendant's place of residence means :
- in the case of a natural person, the place where that person has his domicile or, failing that, his residence,
- in the case of a legal entity, the place where it is established.
In contractual matters, in addition to the court for the place where the defendant resides, the plaintiff may choose to bring proceedings in the court for the place where the goods were actually delivered or the service was provided.
Article 17: Information technology and civil liberties
The information requested from the consumer is required to process the order. Consumers have the right to access, rectify and delete any data concerning them at any time, in accordance with the conditions set out in the law of 6 January 1978.
